- Knoxxa Digital Ltd – Terms of Service for Starlink Services
This Terms of Service (“Terms”) outlines the agreement between you, the customer ("user"), and Space X Starlink GH LTD (referred to as "Starlink") for Starlink's two-way satellite-based internet service (“Services”) and the Starlink Kit, which includes a Starlink antenna, Wi-Fi router, and mount (“Starlink Kit” or “Kit”). By placing an Order, you agree to these Terms as they apply to Ghana.
1. Deposit
1.1 Applicability
If Starlink Services are currently unavailable in your region, your deposit secures your place in the queue for priority access once available.
1.2 Deposit Payment
Deposits include VAT and are fully refundable before your Starlink Kit is shipped. Once services become available, your deposit is applied toward Kit or subscription charges.
1.3 Availability and Limitations
Deposits do not guarantee availability of Services or Kit, nor fixed pricing. Prices may change before final purchase. Deposits are non-interest-bearing and not held in escrow
2. Agreement to Purchase or Rent the Starlink Kit and Services
2.1 No Resale or Unauthorized Use
You may not resell the Services or act as an unauthorized service provider. Doing so may result in termination.
2.2 Payments for Purchasing the Kit
You authorize Knoxxa to charge your selected payment method for the Kit, accessories, and related costs. Ownership of the Kit transfers to you upon delivery.
2.3 Payments for Renting the Kit
- Activation Fee: Payable immediately upon order.
- Monthly Rental Fee: Charged upon activation.
- Penalty: If the rented Kit is not returned within 30 days of service cancellation, you will be charged the full retail price of the Kit.
2.4 Monthly Service Payments
- Monthly Service Fee: Billed at activation.
- Late Payments: A late payment fee of GHS 50 will be applied to any invoice that remains unpaid more than 30 days after the due date. If payment is delayed beyond this 30-day period, Knoxxa reserves the right to suspend or terminate services without further notice.
- No Unlimited Plans: Unlimited data plans are no longer available. All service plans are subject to data limits or fair use restrictions.
3. Starlink Kit Installation
3.1 Installation Guidelines
You may install the Starlink Kit yourself, following all instructions. Alternatively, Knoxxa Digital offers professional installation services for an additional fee. Installation pricing varies depending on your location. Any unauthorized changes to the equipment may void warranties. Knoxxa and Starlink are not responsible for installation-related damages or building modifications.
3.2 Installation Permissions
You must obtain any required permissions or permits and comply with local building regulations before installing the Kit.
4. Fixed Service Plans
Starlink offers several fixed service plans such as Residential Lite, Residential, and Priority. Each plan comes with varying speeds and data limits as outlined in Starlink’s Fair Use Policy. Unlimited data is no longer available.
5. Mobility Service Plans
5.1 Roam Plans
Plans like Roam 50GB provide access within supported regional zones. Access may be restricted when used outside these zones.
5.2 Mobile Priority Plans
These plans are designed for high-demand use, including at sea or across borders. All are subject to priority data limits and no longer include unlimited access.
6. Changes, Cancellation, Returns, Transfers, and Termination
6.1 Changes by Knoxxa and Starlink
Knoxxa and Starlink reserve the right to change pricing, service plans, and Terms. Any changes will be communicated at least one (1) month in advance.This includes changes during an active one-year contract.
If pricing changes occur mid-contract, you will receive notice two months in advance. The price difference for the remaining term will be added to your final bill at the end of the contract period.
6.2 Service Cancellation
You may cancel your monthly subscription plan at any time via your Knoxxa or Starlink account. Cancellations take effect at the end of the current billing cycle.For one-year contract customers, cancellation is only allowed at the end of the one-year contract term. Early termination is not permitted.
6.3 Kit Return and Refund
Returns of purchased Kits are accepted within 30 days of delivery. Refunds cover hardware and initial subscription fees, subject to Starlink’s return policy and the condition of the returned Kit.
6.4 Rented Kit Returns
If you rent a Kit, it must be returned in good condition within 30 days after cancellation. If not, you will be charged the retail value.
6.5 Contract Renewals
One-year contracts automatically renew unless cancelled in writing 30 days before renewal. Additional charges from pricing changes may be included at the end of the contract.
7. Limited Warranty and Disclaimers
7.1 Limited Warranty
All Starlink Kits are covered by a limited manufacturer warranty. Services and equipment are otherwise provided “as is” with no additional warranties beyond what is required by law.
8. Compliance
You must comply with Ghanaian laws and with Starlink’s Acceptable Use Policy, Privacy Policy, and any applicable international trade laws.
9. Indemnification
You agree to hold Knoxxa and Starlink harmless from any claims, damages, or losses resulting from your use of the Services or your breach of these Terms.
10. No Unauthorized Transfers
10.1 Transfers and Assignments
You may not assign this agreement or transfer Services to another person or property without Knoxxa’s prior written consent. Unauthorized transfers may lead to termination.
11. Governing Law and Disputes
This agreement is governed by the laws of Ghana. All disputes arising from these Terms will be handled under Ghanaian jurisdiction. For services provided outside Earth (e.g., on Mars), Starlink’s independent principles may apply.
12. General Provisions
12.1 Customer Support
Support is available via the Knoxxa Customer Portal. Calls may be recorded for quality purposes.
12.2 Severability
If any part of these Terms is found to be invalid, the rest will remain enforceable.
12.3 Eligibility
You must be at least 18 years old to subscribe to Starlink Services.
12.4 Record-Keeping
It is your responsibility to save a copy of these Terms. Updates will be posted to the Customer Portal.
12.5 Notices and Electronic Delivery
By using the Services, you agree to receive all notices via email or portal notifications.
12.6 No Waiver
A waiver by Starlink must be provided in writing and does not imply a waiver of future breaches.
